Webtalk Privacy Policy

Safeguarding your privacy is important to us. Before you submit information through websites owned and operated by Webtalk, Inc. or its affiliates (“Webtalk”), we want you to know how it will be used and how it is protected. By using the webtalk.com website (the “Site”) or the Webtalk-branded apps, SocialCPX, EventWave and other Webtalk-related sites, apps, communications and services (the “Services”) as well as off-Site Services, including but not limited to ad services we may offer and adjunct services like “Apply with Webtalk” and “Share with Webtalk” plugins, you represent and agree that you have read this Privacy Policy and consent to the use of your personally identifiable information ("Information") by Webtalk and others in accordance with its terms and for the purposes described below.

Our published Terms of Use govern any dispute that may arise concerning our Privacy Policy or your use of our Site  and the Services, as well as off-Site Services, including limitations on damages, venue of disputes in Florida, and application of Florida law.

Webtalk operates a social media and networking service at the Site.  At the Site, registered users (“Members”) share their professional identities, engage with their network, exchange knowledge and professional insights, post and view relevant content, learn and find business and career opportunities. Content on some of our services is available to non-members (“Visitors”).

This Privacy Policy applies to the Site, the Services, and the off-Site services (but excludes services, if any, that state they are offered under a different privacy policy).  If you use the Site, our Services or the off-Site services, you consent to the collection, use and sharing of your personal data under this Privacy Policy and agree to the Terms of Use. We provide you choices that allow you to opt-out or control how we use and share your data.

Types of information collected and logged by Webtalk

Information we collect through this Site and via emails and other communications you may send us may include your first and last name, home or physical street address, an email address, a telephone number, your birthday, and other information that permits a specific individual to be contacted physically or online or that is collected about you and stored by us in personally identifiable form.

To create an account and become a Member, you provide data that includes your names, email address and/or mobile number, and a password.  Therefore, if you create a user account and become a Member, we will collect your contact details.   If you register for a premium Service, we ask you for payment (e.g., credit card) and billing information.

As a Member, you will be able to create and curate your Member profile.  You have choices about the information on your profile, such as your education, work experience, skills, photo, city or area and endorsements. Within the framework the Site provides, you can decide which information to include in your profile, including whether to include sensitive information on your profile. Please do not post or add personal data to your profile that you would not want to be publicly available.

We collect personal data from you when you provide, post, or upload it to our Services, such as when you fill out a form, respond to a survey, send a communication via our Services or the Site, or otherwise. If you opt to import your address book, we receive your contacts (including contact information your service provider(s) or app automatically added to your address book when you communicated with addresses or numbers not already in your list).   We may later add functionality that permits you to sync your email or calendars with our Services.  If we add that functionality and you choose to sync your email or calendars with our Services, then we will collect your “email header” and calendar meeting information (e.g. times, places, attendees and contacts).

We collect information about you when you send, receive, or engage with messages in connection with our Services.

Our Services let both you and others post content that includes information about you on our Services (for example, as part of blog posts, feed updates, videos, and photographs).  Unless you opt-out, we collect public information about you, such as professional-related news and accomplishments and make it available as part of our Services (for example notifications of mentions in the news).

We also receive personal data about you when others import or sync their address book with our Services, or send messages using our Services (including invites or connection requests).  We may later add functionality that permits others to sync their calendars with our Services.  If we add that functionality and others choose to sync their calendars with our Services, then we will receive and personal information about you.

Our Services also permit imports of data from other social media platforms.  If you import your data from another social media platform, then we will collect the data you have provided to that platform, as well as metadata that is part of the import (for example, likes, shares, etc.).  Our Services also use Artificial Intelligence (“AI”) facial and image recognition, so we are able to store, tag, and label the contents of images that are provided to us by you or by others.

In your use of our messaging functions (when you communicate through our Services) we collect information about you when you send, receive, or engage with messages in connection with our Services. For example, if you get a Webtalk connection request, we track whether you have acted on it and will send you reminders. We also use automatic scanning technology on messages.

Our Services permit, or will permit, your employer to buy a premium Service for you to use at work.  If your employer does so, your employer may provide data about you to us.  For example, we will get contact information for “Company Page” administrators and for authorizing users of our premium Services.

We receive information about your visits and interaction with services provided by others when you log-in with Webtalk or visit others’ services that include our plugins (such as “Share on Webtalk” or “Apply with Webtalk”), ads, cookies, or similar technologies.

In addition to information that is personally identifiable information, we also maintain standard web logs that record data about all visitors to this site. These logs may contain (1) the internet domain name from which you access the Site; (2) your IP address; (3) the type of browser and operating system you use; (4) the date and time you visited this site; (5) the pages you saw on this site; and (6) the address of the website you linked here from.  We also get information about your IP address, proxy server, operating system, web browser and add-ons, device identifier and features, and/or ISP or your mobile carrier.  We also collect geolocation information, meaning that if you use our Services from a mobile device, that device will send us data about your location. Most devices allow you to prevent location data from being sent to us and we honor your settings   Lastly we connect information, including current session information via "cookies" when you access our site.

Our Services are dynamic and we often introduce new features, which may require the collection of new information. If we collect materially different personal data or materially change how we use your data, we will notify you and may also modify this Privacy Policy.

We maintain physical, electronic, and procedural safeguards that comply with applicable law to protect any non-public personal information we collect.

Cookies and Site Usage

Cookies are pieces of information (alphanumeric identifiers) that we transfer to your computer's hard drive through your web browser to enable our systems to recognize your browser and to provide certain features at the Site.  Cookies make web surfing easier for you by saving your identification information (such as username, password, , etc.) while you are at a site. Cookies also track where you travel on a site, what you view, and what you purchase.  The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. However, cookies allow you to take full advantage of the features on the site, and we recommend that you leave them turned on.  If you disable cookies on your web browser or otherwise adjust your privacy settings, then your experience at our Site may not be as robust as it otherwise might be.

We use our own cookies to help determine which of our ads are shown to you on our Site and other websites.  We can use a Member’s posts and cookie information to gather demographic and marketing information, such as buying habits, preferred brands, and other information.  We couple that information with information derived from AI sentiment analysis.  To opt-out of offsite advertising tracking and measurement, please click here.

In addition to cookies, our servers automatically collect data about your server’s or computer’s internet address when you visit our Site, called its Internet Protocol, or “IP Address.”  Your IP Address is a number that is automatically assigned to your computer whenever you are using the internet.  When you visit pages on our Site, our servers may record your IP Address and your domain name.

If we send email to you, then we may use tools to capture data related to when or if you open our message, and whether you click on any links or banners the email contains, and whether you make any purchases.

We also work with third-party companies that use their tracking technologies (including but not limited to cookies and pixel tags) on our Site in order to provide tailored advertisements on our behalf and on behalf of other advertisers across the Internet.  This activity typically is called “interest-based advertising.”   These companies may collect information about your activity on our Site and your interaction with our advertising and other communications and use this information to determine which ads you see on third-party websites and applications. Please note that even if you opt-out, these tracking technologies may still collect data and you will still see ads, but they will not be targeted based upon the information collected through these tracking technologies.

How We Use Your Information and Who has Access to Your Information

We use your personal Information and other data we collect or store about you to provide support and to personalize and make our Services more relevant and useful to you and to others.  How we use your personal data will depend on which Services you use, how you use those Services, and the choices you make in your settings.

Your profile is fully visible to all Members and customers of our Services. Every data set on your profile has its own individual privacy settings that you can use to control which data is shown to any specific set of users.  Using the Service, you can view and share information (using posts, likes, comments, follows, etc.)  If you share information using the Service, then it will be shared publicly unless you specifically set another setting.

Some Members (or their employers) need, for legal or professional compliance, to archive their communications and social media activity, and will use services of others to provide these archival services. We enable such archiving outside of our Services.


We use your data to authenticate you and to provide access to our Services.  We also use your data, by itself or combined with other data, to conduct research and development for the further development of our Services in order to provide you and others with a better, more intuitive and personalized experience, drive membership growth and engagement on our Services, and help connect professionals to each other.

The Services allow you to stay in touch with and to communication with others, by “connecting” with the colleagues you choose and who which to connect with you.  We use the data about you to suggest connections for you and for others and to enable you to invite others to become a Member and to connect with you.  When you invite someone to connect with you, your invitation will include information you have provided, including but not limited to your name, photo, and contact information.  The Service will permit you to share your list of connections with your connections.

We may contact you through email, notices posted on our websites or apps, messages to your Webtalk inbox, and other ways through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. We also send messages about how to use the Services, network updates, reminders, and promotional messages from us and our partners. You may change your communication preferences at any time. Please be aware that you cannot opt out of receiving service messages from us, including security and legal notices.

We may use your image and likeness for the purpose of inviting your contacts if you upload your contacts to invite them to become Members and use our Service as well as in email notifications to your contacts letting them know about any interactions you have had with them while using our Services.

We offer and sell premium Services that provide our customers customized-search functionality and tools.  These subscribers can export limited information from your profile, such as name, headline, current company, current title, and general location, in order to manage sales leads or talent, unless you opt out. We do not provide contact information to these subscribers as part of these premium Services without your consent. A premium Services subscriber can store information he/she has about you in our premium Services, such as a resume or contact information or sales history. The data provided about you by these subscribers is subject to the policies of those subscribers.

We use data you provide as needed to investigate, respond to, and to resolve complaints and issues with the Service.

Affiliates, Joint Marketing, and Advertising

We share information among our subsidiaries and affiliates in accordance with our security standards and confidentiality policies, and applicable laws. We may also disclose your information to third parties that perform marketing services on our behalf or to other companies with whom we have joint marketing agreements.  In addition to disclosing information you provide, we may use and share data about you that is provided by others (your contacts, for example), as well as data like purchasing history, cookie history, and other data we collect for purposes of targeted advertising.  We may disclose that data and information to third parties that perform marketing services on our behalf or to other companies with whom we have joint marketing agreements.

Based on the data we collect and generate, we serve tailored advertisements to you.  In other words, we not only target advertisements to Members and Visitors, but also measure the performance of the advertisements.  We use and combine Member-provided information, data from your use of the Services, information from third parties, data from advertising technologies like cookies, and information that we infer from the types of data described above.

Business Partners and Agents:

We also may share information with non-affiliated business partners and agents with whom we have agreements to help perform functions on our behalf. Examples include but are not limited to sending postal mail and e-mail, , analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. These parties have access to personal information needed to perform their functions, but may not use it for other purposes.  We may enter into agreements with financial institutions.  For purposes of performance of those agreements by us and by the financial institution, we may share customer information, including transaction information and other personal identifying information, with that financial institution.

Others’ Services

You can opt to link your account with other services, including other social media platforms.  If you do so, then your personal data will become available to those services. The sharing and use of that personal data will be described in, or linked to, a consent screen when you opt to link the accounts. For example, you may link your Facebook or LinkedIn account to share content from our Services into these other services, or your email provider may give you the option to upload your Webtalk contacts into its own service. You may revoke the link with those accounts.

Subject to your settings, excerpts from your profile will appear on the services of others (e.g., search engine results, mail and calendar applications that show a user a “mini” Webtalk profile of the person they are meeting or messaging, social media aggregators, talent and lead managers). “Old” profile information remains on these services until they update their data cache with changes you made to your profile.

Related Services

We share your data across our different Services and Webtalk-affiliated entities.  We will share your personal data with our affiliates to provide and develop our Services. We combine information internally across the different Services covered by this Privacy Policy. For example, EventWave (a Webtalk product) will recommend better content to you based on your Webtalk profile or the articles you read on your newsfeed, and Webtalk could personalize your feed or job recommendations based on your learning video history, because we are able to identify you across different Services using cookies or similar technologies.

Business Transfers

As we continue to develop our business, we might sell or buy subsidiaries, or business units, or may sell substantially all of our assets or shares. In such transactions, customer information generally is one of the transferred business assets. In the event that Webtalk or substantially all of its assets are acquired, customer information, including information you have provided to Webtalk, will be one of the transferred assets.

Legal Protection of Webtalk and Others

We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Webtalk, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. This does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the commitment set forth in this Privacy Policy.

Intended Users: Use By Children Under 13

The Site is not purposefully directed at children under the age of 13 and the Services available on the Site are intended for use by adults. We do not collect or maintain information, via the Site or otherwise, from individuals for whom we have actual knowledge they are children under the age of 13.  If you notify us that Information has been provided by a child under the age of 13, upon verification, we will promptly delete and not retain that Information.

Choices You Can Make and Obligations You Have

We retain the personal data you provide while your account is in existence or as needed to provide you Services. We will retain your information and keep your profile open until you decide to close your account. In some cases we choose to retain certain information (e.g., visits to sites carrying our “Connect with Webtalk” or “apply with Webtalk” plugins without clicking on the plugin) in a depersonalized or aggregated form. 

If you deactivate your Webtalk account, your personal data will generally stop being visible to others on our Services within 24 hours. Upon reactivation, which occurs upon logging back into Webtalk after deactivation, all of your account data will be restored to the network.

We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our Terms of Use, or fulfill your request to “unsubscribe” from further messages from us. We will retain de-personalized information after your account has been closed.  We also may retain and use your image and likeness for a period of up to 12 months after you deactivate your account for the purpose of inviting your contacts if you upload your contacts to invite them to become Members and use our Service.

Information you have shared with others (e.g., through TalkMail, updates or group posts) will remain visible after you closed your account or deleted the information from your own profile or mailbox, and we do not control data that other Members copied out of our Services. Group content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others (e.g., search engine results) until they refresh their cache.


How You Can Change or Update Your Information

You can access or delete your personal data. You have many choices about how your data is collected, used and shared.

If you want to change, edit, or update the information you have provided to us and that we have stored, you can log into your user profile on our Site and correct, amend, or delete information about yourself.  If that functionality becomes unavailable, contact us at the “Contact Us” information provided below to find out what information we have collected about you, and to request any changes.

We retain the personal data you provide while your account is in existence or as needed to provide you Services. We will retain your information and keep your profile open until you decide to close your account.

We keep some of your data even after you close your account.  If you choose to close your Webtalk account, then your personal data will generally stop being visible to others on our Services within 24 hours. We generally delete closed account information within 30 days of account closure, except as noted below.

How We Respond to Do Not Track Signals

We do not currently recognize automated browser signals regarding tracking mechanisms, which may include "Do Not Track" instructions. You can change your privacy preferences regarding the use of Tracking Technologies through your browser. However, if you do adjust your privacy preferences, certain functionality of the site may be affected.  Additional information about Do Not Track requests as it applies to California residents is available at the portion of this Privacy Policy entitled Your California Privacy Rights. Removing tracking via the browser will result in a forfeiture of any commissions earned from Webtalk’s SocialCPX affiliate program if applicable. Using ad blockers on Webtalk will also result in a forfeiture of any commissions earned from Webtalk’s SocialCPX affiliate program if applicable.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. 

In addition, we make this disclosure concerning tracking technology as it relates to California residents.  Since Do Not Track technology has not been fully standardized, we do not respond to Web browser ”Do Not Track” signals at this time. We await the result of work by the policy community and industry to determine when such a response is appropriate and what form it should take. We do allow you to exercise choice regarding the collection of information by third parties about your online activities over time and across third-party Web sites or online services for online interest based advertising purposes by going to http://www.networkadvertising.org.

These opt-out mechanisms rely on cookies to remember your choices with respect to ad-serving on websites. If you delete your cookies, use another computer or device, or change browsers, then you will need to repeat this process. In addition, opting out of interest-based ads will not opt you out of all ads, but rather only those ads that are personalized to your interests based on activities observed on websites not owned and operated by Webtalk.

As noted in our general Privacy Policy, Webtalk may participate in interest-based advertising.  We may automatically collect information regarding how you browse our Site and other websites for reasons that may include but are not limited to improving your customer experience, improving our customer experience, and providing you with communications and promotions from Webtalk and from other third parties. 

Our privacy policy describes, among other things, how we may share your Information for marketing purposes like interest-based advertising.  If you are a California resident and have an established business relationship with us, then you can request a notice disclosing the categories of personal information we have shared with third parties, for the third parties’ direct marketing purposes, during the preceding calendar year. You may request that information once a year.  To request a notice, please submit your request to Webtalk. If you are a California resident under 18 years old and a Member, then you can request that we remove content or information that you have posted to our website or other online services. Note that fulfillment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user). Security of Information

We work to protect the security of your information during transmissions by using Secure Sockets Layer (SSL) software, which encrypts information you input. We reveal only the last five digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing. It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when you have finished using a shared computer. You can access certain information we maintain about you by contacting us via email at privacy@webtalk.co.

Information that you provide to us will be stored and processed on our computers in the United States. The laws on holding such information in the United States may vary and be less stringent than laws of your state or country. We will use commercially reasonable efforts to hold and transmit the information that you provide to us in a safe, confidential and secure environment. If you object to the information that you provide to us being transferred or used in this manner please do not register with or use the Site.

While we use industry standard methods to protect your Information, no e-commerce solution, website, mobile application, database or system is completely secure or "hacker proof." You are also responsible for taking reasonable steps to protect your personal information against unauthorized disclosure or misuse.

Privacy Policy Coverage

Please be aware that other sites and third-party content (for example, banner advertisements that you may access through our Site may collect personally identifiable information about you. The information practices of those third party sites linked to our Site are not covered by this Privacy Policy. This Privacy Policy is not intended to cover any information collection practices that take place outside of our site, regardless of whether they are controlled by us.

How to Opt-Out or to Contact Us

If at any time you wish to stop receiving e-mail from us, you can always remove your name from our mailing list by sending an e-mail to the contact information below, by email stating that you wish to unsubscribe and indicating in the subject line of the e-mail "STOP EMAIL." Although we will promptly remove your name from our e-mail list upon receiving your request, it is possible that you may still receive e-mails from us that had been initiated prior to your name being removed from our list.

Webtalk’s services are hosted in the United States and are intended for visitors located within the United States. If you choose to access a Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling you requests, and operating the service.
